Eco Driving Trial Participation Terms

Introduction

Linkt and Linkt Brisbane are trade marks of Transurban Limited used under licence by Queensland Motorways Management Pty Ltd ABN 86 010 630 921 (“Transurban” or “we” or “us” or “our” or “Linkt Brisbane”). We are conducting a trial (the “Trial”) in which participants will use a device which records their behaviour while driving to allow us to understand ways drivers could drive more efficiently.

By submitting a Trial registration form to us, you agree to participate in the Trial on these terms (“Terms”). If you don’t agree (or cannot comply) with these Terms, then you may not participate in the Trial and should not submit a registration form.

We may make changes to these Terms from time to time. We will notify you of any changes by sending you an email at the email address you provide on the Trial registration form and by publishing the amended Terms on our website at linkt.com.au/Brisbane. The amended Terms will apply automatically from the time they are published.

Please read these Terms carefully. They cover important information about the Trial including the things you agree to do if you are eligible and agree to participate.

The Trial has no impact on your Linkt account, and your Customer Service Agreement will continue to apply in addition to these Terms.

What is the Trial?

Participants will be required to install a device in their vehicle (the “device”) and download and register for a mobile application which interfaces with the device (the “mobile app”). The device and mobile app are supplied by GOFAR Pty Ltd ACN 610 842 656 (“GOFAR”).

Once installed, the device and mobile app collect certain data about participants’ driving behaviour on each trip, including:

  • breaking frequency;
  • acceleration;
  • idling;
  • coasting;
  • speed of vehicle and average speed;
  • fuel consumption;
  • distance travelled;
  • trip duration; and
  • CO2 emissions.

The objectives of the Trial include:

  • to evaluate driver behaviour; and
  • to evaluate the potential for changes in driving techniques and customer driver behaviour that may reduce fuel consumption and therefore carbon emissions.>

When will the Trial take place?

The Trial will start at 12am April 19th and continue until 11:59pm 6 June 2021, unless we tell you otherwise.

Am I eligible to participate?

To be eligible to participate in the Trial, you must:

  • have a current driver’s licence;
  • own your own vehicle (which is not a motorcycle, or a vehicle used for commercial purposes or a non-compliant vehicle) and be the main driver of that vehicle;
  • be willing to install the device in your vehicle and keep the device in your vehicle for the duration of the Trial;
  • live in Queensland; and
  • have a mobile device running an Android or iOS operating system.

How do I participate in the Trial?

If you meet the Eligibility Criteria and wish to participate in the Trial, you must submit an online Trial registration form to us.

In the Trial registration form, you must:

  • provide your email address;
  • provide your name and mailing address for device delivery;
  • confirm that you meet the Eligibility Criteria.

By submitting the registration form to us, you agree to participate in the Trial and that:

  • you have read, understood and accept these Terms; and
  • you meet the Eligibility Criteria.

We will assess your eligibility to participate in the Trial based on the information you submit to us in your Trial registration form. If you are within the first 500 participants to submit a Trial registration form before the Trial start date, who meets the Eligibility Criteria, we will notify you via the email address you provided in the Trial registration form that you have been accepted to participate in the Trial.

You will be a participant in the Trial if we confirm your eligibility to participate.

If at any time during the Trial you do not meet the respective Eligibility Criteria or comply with the conditions of participation outlined in these Terms, we may immediately remove you as a participant in the Trial. We will contact you within a reasonable time to let you know if this is the case.

How do I use the device?

Once we confirm your participation in the Trial, we will mail or hand deliver the device to you at the address you provided in the Trial registration form.

You will need to install the device in your vehicle and download and register for the mobile app using the instructions provided with the device. You must install the device and register for the mobile app within 3 days of receiving the device.

You acknowledge that, once you have installed the device in your vehicle and downloaded and registered for the mobile app, you will be bound by GOFAR’s terms and conditions in relation to the device and mobile app (available at both iOS App Store and Android Google Play store) in addition to these Terms. You use the device at your own risk.

What do I need to do during the Trial?

During the trial, you must:

  • ensure the device is operational for the duration of the Trial;
  • not remove the device from your vehicle unless you wish to leave the Trial; and
  • complete the mid-pilot and end-of-pilot survey.

 

You must notify us immediately if, during the Trial, you crash your vehicle, sell your vehicle or if your vehicle otherwise becomes unusable.

What happens at the end of the Trial?

The Trial will automatically end at 11:59pm on the 21 June 2021, unless we tell you otherwise.

If you would prefer to leave the Trial earlier, you can do so at any time by emailing ecodriving@transurban.com, removing the device from your vehicle and deleting the mobile app from your phone.

At the end of the Trial, you may keep the device installed in your vehicle. If you continue to use your device after the end of the Trial, you will continue to be subject to the GOFAR Terms.

Your personal information

By participating in the Trial, you agree that we can collect, use and disclose your personal information in accordance with our privacy policy (available at https://www.linkt.com.au/legal/policies/transurban-privacy-policy). Your use of the device and mobile app will also be subject to GOFAR’s privacy policy which is incorporated into the GOFAR Terms.

In particular, you agree:

  • we may collect personal information about you as provided by you in your Trial registration form for the purpose of determining your eligibility to participate in the Trial, and to conduct the Trial;
  • we may disclose your email address to GOFAR to allow GOFAR to identify and monitor Trial participants;
  • during the Trial, GOFAR will collect data about your driving behaviour using the device and mobile app (“Trial Data”), and will disclose the Trial Data to Transurban.

 

We may use the Trial Data for the following purposes:

  • Determine the environmental and sustainability benefit of eco-driving through the changes in driver behaviour;
  • Compare individual benefit of eco-driving techniques against other trial participants; and
  • Develop research report by analysing aggregating data
  • Use participant survey responses for future Transurban or Linkt communications

 

You also agree to receive communications and notices from Transurban in relation to the Trial.

If you continue to use the device after the end of the Trial, any data collected by GOFAR after that date will not be disclosed to Transurban, and will be governed by GOFAR’s privacy policy which is incorporated into the GOFAR Terms. Transurban is not responsible for any collection, use or disclosure of data by GOFAR following the end of the Trial.

Our Liability

You may have rights as a consumer under the Australian Consumer Law. Nothing in these terms limits or excludes our liability:

  1. under the Australian Consumer Law, except to the extent we are permitted to limit or exclude our liability under the Australian Consumer Law, or
  2. for personal injury or death caused by our negligence.

 

You acknowledge and agree that:

  • the device and mobile app are provided and operated by GOFAR, a third party;
  • we do not guarantee that the device or mobile app will always be available or functioning correctly, or will be fault free or risk free;

 

Except as set out above, we are not liable to you or to any person who drives a vehicle with an installed or any other road user or any person claiming through you in relation to:

  • any loss or damage suffered or sustained as a result of, or in any way connected with, your registration or participation in the Trial;
  • any loss or damage arising out of your use, installation or removal of the device;
  • any loss or damage arising out of any error or fault in relation to a device;
  • any loss or damage arising out of or relating to any false or misleading statement made by GOFAR; and
  • any loss of opportunity, loss of profit, loss of revenue, loss of anticipated savings or loss that would be considered consequential or indirect, irrespective of how that loss was caused and whether arising under this contract or under another principle of law.
