First Week Free Trial Offer on Brisbane’s Linkt Network terms and conditions

  1. Linkt is a service operated in Brisbane by Queensland Motorways Management Pty Ltd ABN 86 010 630 921 (Linkt).
  2. These Terms and Conditions contain information on how to enter the 'First Week Free Trial Offer on Brisbane’s Linkt Network' Promotion (the Promotion) and the gifts available. By participating in the Promotion, claimants agree to be bound by these Terms and Conditions. Claims for gifts must comply with these Terms and Conditions to be valid.
  3. The promoter is Queensland Motorways Management Pty Ltd ABN 86 010 630 921 of 7 Brandl St, Eight Mile Plains QLD 4113, telephone number (07) 3323 0000 (the Promoter).
  4. The Promotion commences at 00.00 AEST on Thursday, 7 June 2018 and closes at 23.59 AEST on Sunday, 5 August 2018 (the Promotional Period).
  5. Entry is open to all Queensland residents aged 18 years or over. The following persons are ineligible to enter:
    1. directors, management and employees (and their respective Immediate Families) of the Promoter;
    2. the Promoter's retailers, suppliers, associated companies and agencies who are associated with the Promotion and their directors, management and employees (and their respective Immediate Families)
    3. any person who already has a Linkt Prepaid Tag or Tagless account (Linkt Account) one (1) day prior to the Promotional Period (6 June 2018).

    Immediate Family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

  6. Each gift is digital toll credits which will be reimbursed to the claimant’s Linkt Account in respect of all tolls and video matching fees (each an Eligible Fee) that are incurred by the claimant for the first 7 days of travel (including any backdated travel) incurred on Brisbane’s Linkt network up to a maximum of $50.00 (the Gift).
  7. To claim a Gift, an eligible person must, during the Promotional Period:
    1. sign up for a new Linkt Prepaid Tag or Prepaid Tagless Account (the Promotional Websites);
    2. accept the Terms and Conditions relating to the Linkt Account (available at the Promotional Websites), including any applicable Privacy Policy (Account T&Cs); and
    3. travel on Brisbane’s Linkt network within 7 days of the date on which you open your Linkt Account during during the Promotion Period.

    For the avoidance of doubt, this Promotion does not apply to any person who signs up to a new Linkt Commercial Account or Road Pass.

  8. In accordance with clause 7, a claim must be received by the Promoter by the end of the Promotional Period or it will not be accepted. Claims are deemed to be received at the time of receipt by the Promoter, not at the time of electronic transmission by the claimant.
  9. Limit applies of one Gift per person and per account. Persons who register multiple Linkt Accounts using multiple addresses or aliases may be disqualified. The Promotor will notify the claimant by SMS or email if the claimant is disqualified. The Gift applies only once to each Linkt Account, even if two or more persons share that account.
  10. For the avoidance of doubt:
    1. the Gift will not be applied in respect of tolls and other fees that have been transferred from a toll invoice or notice of demand to the claimant's Linkt Account;
    2. any vehicle licence plate number on an existing Linkt Prepaid Tag or Tagless account or a Linkt Commercial Account, one (1) day prior to the Promotion Period (6 June 2018) is also ineligible to enter into this Promotion; and
    3. any travel on tollroads which are not part of Brisbane’s Linkt network is excluded from this Promotion.
  11. The Gift will be credited as follows:
    1. If an Eligible Fee is incurred on or after the date on which the claimant's Linkt Account is opened, a digital toll credit of an amount equal to the Eligible Fee or the remaining amount of the Gift, whichever is less, will be credited by direct credit to the claimant's Linkt Account, within 48 hours of the date the Eligible Fee is incurred.
    2. If an Eligible Fee is incurred up to 7 days prior to the date on which the claimant's new Linkt Account is opened and the claimant backdates the start date of their new Linkt Account in accordance with the Account T&Cs so that the new Linkt Account covers the trip, a digital toll credit of an amount equal to the Eligible Fee or the remaining amount of the Gift, whichever is less, will be credited by direct credit to the claimant's Linkt Account, within 48 hours of the date the Link Account is opened.
  12. If a claimant closes their Linkt Account after making a claim and before the maximum value of the Gift is credited, the Gift or any remaining amount of the Gift not used or credited will be forfeited by the claimant and cash will not be provided in lieu of the Gift or any portions thereof. If a claimant does not incur Eligible Fees up to the maximum value of the Gift, any remaining amount of the Gift which is not used will be forfeited by the claimant and cash will not be provided in lieu of the Gift or any portions thereof.
  13. The Promoter takes no responsibility should a person not have the software, hardware or mobile plan that permits access to, and use of, the Promotional Websites, or to receive a Gift. Any costs associated with accessing the Internet, downloading data on a mobile device, or using any device to access and use the Promotional Websites, or to receive a Gift, is the sole responsibility of the claimant and is dependent on the Internet/mobile service provider used.
  14. Gifts, or any portions of Gifts, are not transferable, exchangeable or redeemable for cash. Stated Gifts values are the recommended retail value (including GST) in Australian dollars are provided by the supplier and are correct at the time of printing.
  15. If the Gifts, or component thereof, becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute the Gifts, or a component of a gift, of equal or greater RRP value at the Promoter's sole discretion, subject to any written directions from the relevant authorities. Claimants will not be entitled to any additional compensation in the event that the Gifts (or component thereof) have been substituted at equal or greater RRP value.
  16. To the extent permitted by law, the Promoter accepts no responsibility for:
    1. any late, lost or misdirected entries or other communications; or
    2. any Internet traffic congestion or problems with, or technical malfunction of, any hardware or software, including but not limited to any damage to the hardware or software of any claimant or other persons related to participation in the Promotion.

    The decision of the Promoter is final and binding; no correspondence will be entered into.

  17. To the extent permitted by law, the Promoter (including its officers, employees and agents) will not be responsible for any acts of god, acts of terrorism or war (declared or undeclared), state of emergency, disaster, technical failures, security breaches, tampering, unauthorised intervention, fraud, computer viruses or other events beyond the Promoter’s control which affect the proper or reasonably anticipated conduct or administration of the Promotion, or prevent the transfer of the Gifts in accordance with these Terms and Conditions. If such an event occurs, the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion, subject to any written directions from a relevant regulatory authority.
  18. Nothing in these Terms and Conditions limits, excludes or modifies the statutory consumer guarantees provided under the Competition and Consumer Act 2010 (Cth), or any other implied warranties under any legislation in Australia. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including for negligence), for any personal injury or any loss or damage (whether direct, indirect, special or consequential) arising in any way out of the Promotion, including but not limited to where such injury, loss or damage arises out of:
    1. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
    2. any theft, unauthorised access or third party interference;
    3. any claim for Gifts that is lost, altered, damaged or misdirected due to any reason beyond the reasonable control of the Promoter;
    4. any variation in the Gifts value to that stated in these Terms and Conditions;
    5. any tax liability incurred by a claimant;
    6. participation in the Promotion or accepting and/or using any component of the Gifts by a claimant;
    7. the conduct, act or omission of any service provider or gift supplier associated with the Promotion; or
    8. cancellation or postponement of any portion of the Gifts for any reason beyond the reasonable control of the Promoter.
  19. The Promoter reserves the right to request verification of age, identity, residential address and any other information from claimants relevant to entry into or participation in the Promotion. Verification is at the discretion of the Promoter, whose decision is final. The Promoter reserves the right to disqualify any individual who provides false information, fails to provide information, conspires with others to gain an unfair advantage or who is otherwise involved in any way in manipulating, interfering or tampering with the Promotion. Claims are void if stolen, forged, mutilated or tampered with in any way.
  20. Claimants consent to the Promoter using their name, likeness, image and/or voice in the event that they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting the Promotion (including any outcome) and/or promoting any products manufactured, distributed and/or supplied or services provided by the Promoter.
  21. Claims remain the property of the Promoter. Details from claims will be collected and used for the purpose of conducting the Promotion (which may include disclosure to third parties, for the purpose of processing and conducting the Promotion) and for promotional purposes surrounding the Promotion. By entering the Promotion claimants consent to the collection and use of their information as described and agree that the Promoter may collect and use this information, or disclose it to other organisations that may use it, in any media for future promotional, marketing and publicity purposes and/or otherwise in accordance with the Promoter's privacy policy, without any further reference or payment to the entrant. Claimants may access, change and/or update their personal information and obtain a copy of the Promoter’s privacy policy by contacting the Promoter on (07) 3323 0000.
  22. The agreement which comes into force under these Terms and Conditions is governed by, and must be construed in accordance with, the laws in force in Queensland, and the Promoter and any consumer who participates in the Promotion submit to the non-exclusive jurisdiction of the courts of that State in respect of all matters arising out of or relating to these Terms and Conditions, and the performance or subject matter of the Promotion.
