12 cents per litre Fuel Offer Discount Terms and Conditions

General

  1. This offer is promoted by Tollaust Pty Ltd (ABN 37 050 538 693) ("Linkt") and delivered by Viva Energy Australia Pty Ltd (ABN 46 004 610 459) Level 16/720 Bourke Street, Docklands VIC 3008, Australia, Ph: +61 3 8823 4444 ("Viva Energy").
  2. This offer is valid from 12AM, 1 April 2024 until 11:59PM, 30 June 2024 (“Offer Period”), unless withdrawn by Viva Energy, Shell Coles Express, Reddy Express or Linkt. Linkt will notify earlier withdrawal of the Offer Period by providing prior notice on its website, in its App or through an email to its customers.
  3. Under this offer a 12 cent per litre fuel discount will be offered to individuals who satisfy the eligibility criteria below, as determined by Viva Energy and Linkt, subject to the Exceptions at clauses 4 to 8 below.

Exceptions

  1. This offer is not able to be combined with the ongoing 4 cent per litre fuel discount offered to Linkt customers.
  2. This offer can only be stacked with the Coles Supermarket shopper dockets offer and the "spend $20 in store on eligible products at Shell Coles Express or Reddy Express to receive 10 cents per litre fuel discount" offer subject to their terms and conditions.
  3. This offer cannot be stacked with any other offer offered to you in whole or part by Viva Energy. If you present any other Viva Energy funded fuel discount offer for redemption from any other party e.g. flybuys, Shell Racing Team app (in addition to the fuel discount offer from Linkt), only the highest cents per litre fuel discount barcode will be redeemable. If all the Viva Energy funded fuel discount offers have the same cents per litre discount value, then only the first fuel discount offer presented will be redeemed.
  4. This offer excludes LPG and AdBlue® products.

Eligibility criteria

  1. To be eligible to receive the 12 cent per litre fuel discount, you must:
    1. be at least 18 years old;
    2. agree to these terms and conditions;
    3. have an active Linkt consumer account (the offer is not available to commercial account customers, LinktGO, Pass holders or customers whose accounts are suspended);
    4. have a vehicle or vehicles registered to your eligible account make a total of 10 or more trips per month on any toll road in Australia during April, May and/or June 2024. A “trip” is a single continuous journey made on a specific toll road;
    5. the primary account holder on your account must be 'opted-in' to receive marketing and promotional communications from Linkt during the month of travel and remain opted-in until the barcode distribution (see clauses 9 - 11 for further information);
    6. comply with the redemption steps in these Terms and Conditions (which involves acceptance of further conditions), to be eligible to claim the discount offered under this offer ("Eligible Claimant"). Linkt reserves the right, in its sole discretion, to determine whether you are an Eligible Claimant.

Redemption steps

  1. To redeem the 12 cent per litre fuel discount as an Eligible Claimant you must, within the Offer Period:
    1. Log into your Linkt account using the Linkt app, tap on the ‘Rewards’ tab and accept Linkt Customer Rewards Terms and Conditions to access your 12 cent per litre fuel discount barcode. This will automatically appear within an Eligible Claimant’s account in the app within the time periods set out in clause 10 below.
    2. consent to the sharing of your personal information (first name, last name, email address, mobile number, postcode and a fuel discount offer membership number) between Viva Energy and Linkt in accordance with the privacy statements provided in the Linkt App and the Linkt website and these terms and conditions;
    3. consent to receive marketing and promotional offers from time to time from Viva Energy (however you can opt out at any time); and
    4. Visit an eligible Shell Coles Express or Reddy Express service station in Australia and fill up your vehicle with a minimum of 2 litres, but no more than 150 litres with any Shell fuel (offer does not apply to LPG, or AdBlue® products)
    5. Enter the Shell Coles Express or Reddy Express service station store, whilst in-store and:
      1. present the discount barcode under the customer facing barcode reader when ready to pay for the fuel. Subject to the Exceptions, the discount will be automatically applied to the fuel price. Pay the discounted price for the fuel.

Offer delivery for Eligible Claimants

  1. The fuel discount barcode will be automatically made available to Eligible Claimants in the ‘Rewards’ tab when logged into their account in the Linkt app by the relevant date(s) specified in the table below.
  2. The fuel discount barcode can only be used once per account (whether by the primary or secondary account holder) during the relevant month of the Offer Period:
    1. Each eligible consumer account can receive a maximum of one fuel discount barcode per month. The barcode can be used at Shell Coles Express or Reddy Express when you fill up your vehicle with a minimum of 2 litres, but no more than 150 litres with eligible Shell fuel (offer excludes LPG and AdBlue® products)
    2. There is a maximum of three fuel discount barcodes available per consumer account over the Offer Period.
    3. The fuel discount barcode has an expiry date listed in table below and must be redeemed before this date. Any unused discount barcodes not used by the date listed below will be forfeited.

Offer conditions

  1. The conditions or exceptions that apply to your use of this Offer under these Terms and Conditions will be those that apply as at the time of redeeming the discount barcode at the Shell Coles Express or Reddy Express service station store.
  2. You agree and acknowledge that you have read these Terms and Conditions and that claiming the fuel discount in this offer is deemed to be acceptance of these Terms and Conditions.
  3. The Shell Coles Express or Reddy Express service station reserves the right to refuse processing the discount offered on the basis of irresponsible mobile or other device use on the forecourt or any dangerous or potentially unsafe or illegal behaviour by you or failure by you to comply with the redemption steps.
  4. This offer is not exchangeable or transferable or redeemable for cash. Offer not valid for Fleet Card, Shell Card, Motorpass or Motorcharge transactions.
  5. If for any reason any aspect of this offer is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of Viva Energy, Shell Coles Express, Reddy Express or Linkt, any of these entities may in their sole discretion cancel, terminate, modify, or suspend the Offer and invalidate any affected entries, or suspend or modify the discount in this Offer. You are solely responsible for ensuring that:
    1. if you have and do use your tablet or smartphone to redeem the offer, that you only use that device safely in-store at Shell Coles Express or Reddy Express and correctly redeem the discount;
    2. you are able to read and open the offer on the Linkt website or Linkt App at the time you wish to access the discount barcode; and
    3. and that it can be read by the barcode reader. You acknowledge that no WI-FI or internet or mobile data access will be provided at the Shell Coles Express or Reddy Express service station and that Viva Energy, Shell Coles Express or Reddy Express and Linkt make no representation or claim in relation to any of the responsibilities set out in this clause and that the responsibilities are outside of Viva Energy, Shell Coles Express, Reddy Express or Linkt’s control. You are solely responsible for having the relevant equipment and services to access the offer via mobile app in-store on a device such as smartphone and valid internet service to their device, or via a print out on paper.
  6. Viva Energy and Linkt reserves the right to disqualify you from this offer/promotion in the event of non-compliance with these Terms and Conditions. In the event that there is a dispute concerning the conduct of the Offer, the decision of the Viva Energy and/or Linkt is final and binding on you and no correspondence will be entered into.
  7. Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these Terms and Conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).
  8. Viva Energy, Linkt Shell Coles Express or Reddy Express and their associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence or wilful misconduct) in connection with this Promotion or accepting or using any offer, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
  9. You agree and acknowledge that the Eligible Claimant’s sole and exclusive remedy for any problems or dissatisfaction with the promotion is to cease participation in the promotion, except where otherwise provided by law.
  10. This promotion is to be used by the Eligible Claimant only and not to be distributed or shared by any means. Where the Eligible Claimant distributes or shares their barcode in contravention of this provision, the Eligible Claimant will be liable for all loss or damage caused or contributed to by this breach.
  11. The governing law and jurisdiction of these Terms and Conditions is Victoria, Australia.
