Transurban Journey Planner & Fuel Finder (Beta) - Terms & Conditions

  1. Transurban Limited (ACN 098 143 410) (“Linkt”, “we”, “us”, “our”) has released new AI powered tools called journey planner (“Journey Planner”) and fuel finder (“Fuel Finder”), referred to together as “New Features”.
  2. The New Features are currently operating as a trial. These features are in active development and may change, be temporarily unavailable, or be discontinued without notice.
  3. The New Features are provided on an as-is, as-available basis. The New Features may be available on selected platforms or device types only, and may be subject to staged rollout.

A. Acceptance of the Terms

  1. By clicking 'Accept' when going through onboarding of the New Features, you accept these Terms & Conditions (“Terms”).
  2. We may change these Terms at any time, and will make the amended terms available to customers on the Linkt app. We will also take reasonable steps to notify you of any material changes to these Terms before they change. By continuing to access or use the New Features after any amendment, you confirm your acceptance and ongoing agreement to these Terms, as amended from time to time.
  3. Your use of the New Features is subject to the Linkt app Terms of Use and the Linkt app Terms of Use are incorporated by reference into these Terms. To the extent of any inconsistency between these Terms and the Linkt app Terms of Use, the latter will prevail.

B. The New Features

  1. The New Features use artificial intelligence to provide route suggestions, toll cost estimates, and fuel price information.
  2. These suggestions are provided as a guide only and may not always be accurate, complete, or suitable for your circumstances. You must exercise your own judgement and comply with all road rules and laws when using these features.
  3. Journey Planner
    1. Journey Planner is not used for charging purposes. Toll charges are calculated based on your actual travel (eg, distance, vehicle class, tag status, and time of travel), not on routes suggested by Journey Planner.
    2. You will use Journey Planner in accordance with the law.
    3. The turn-by-turn navigation is offered in Journey Planner with the expectation that you will obey all road rules, including laws regarding the use of mobile devices when driving, and will adhere to safe use while driving.
  4. Fuel Finder
    1. Fuel prices displayed via Fuel Finder are sourced from third parties. We do not guarantee the accuracy or currency of fuel prices and we are not responsible for any financial decisions you make in reliance on that information.
    2. Discounted fuel at 7-Eleven outlets: additional terms and conditions apply in relation to the discounted fuel prices for 7-Eleven operated service stations that are displayed in Fuel Finder. In particular, the discounted 7-Eleven fuel prices are for eligible customers only. Please refer to the 7-Eleven Offer Terms and Conditions for further information.

C. Privacy & Data Use

  1. When you use the New Features, we will collect, use and disclose your personal information. This is summarised as follows:
    1. Collection: when you use the New Features, we will collect your:
      1. Linkt account details including name and vehicles;
      2. preferred fuel type;
      3. technical device information (including IP address, device type, operating system, cookies, and aggregated in-app behaviour / analytics);
      4. real-time location (where you have permitted the Linkt app to access your device location); and
      5. journey data (including trip origin, trip destination, routes and waypoints),
      (collectively, "Collected Data").
    2. Usage: we will use the Collected Data to:
      1. personalise your experience using the New Features;
      2. provide you with route options, toll cost estimates, and nearby fuel prices; and
      3. analyse and improve the performance of the New Features.

       

    3. Disclosure: the Collected Data may be disclosed (i) to third parties (including information technology suppliers located in Australia or the United States of America) that will help us operate Journey Planner, or (ii) as required by law.
  2. Further information: Please refer to the Journey Planner & Fuel Finder Data Collection Notice (“Collection Notice”) for more information about how your personal information will be collected, used and disclosed in connection with your use of the New Features. Please refer to the 7-Eleven Collection Statement for further information about how your personal information will be collected, used and disclosed when purchasing discounted fuel from 7-Eleven operated service stations.
  3. Consent: If you do not agree to the collection, use, and disclosure of your personal information as set out in these Terms and the Collection Notice, you will not be able to use the New Features. However, your existing Linkt account, use of the other features in the Linkt App and toll services will not be affected.
  4. Location services: If you choose not to provide your location, by turning off location services, you will not be able to access the turn-by-turn navigation features of Journey Planner and will have to manually input your current location if you wish to be provided with suggested fuel stations near you.
  5. Privacy policy: We will handle your personal information in accordance with our privacy policy, available at https://www.transurban.com/privacy, and you can refer to this privacy policy for:
    1. more information about how we handle personal information;
    2. how you can access and correct personal information hold about you; and
    3. how to make a complaint about how we have handled your personal information.
