  1. These Linkt Customer Rewards Terms and Conditions (“Terms and Conditions”) apply to your access to and use of the Linkt Customer Rewards Program via the Linkt app (“Program”) and are in addition to, and incorporate, Linkt App Terms and Conditions, and the Linkt Privacy Policy

  2. By accessing the Program and choosing to participate, you are agreeing to these Terms and Conditions. You agree and acknowledge that you have read these Terms and Conditions and by tapping the “accept” button on the Program membership screen is deemed to be acceptance of these Terms and Conditions.

Definitions

  1. In these Terms and Conditions:

    1. Offer means the offers, discounts, products or services made available to you by Linkt which are provided by a Third Party.

    2. Third Party means a third party unrelated to Linkt that sells, supplies and/or provides the Offer. Linkt does not itself sell, supply or provide Offers under the Program. 

    3. Program means the Linkt Customer Rewards Program.

    4. Member means a Linkt customer who fulfils the eligibility criteria for being a member of the Program (including having accepted these Terms and Conditions).

  2. The Program is promoted by CityLink Melbourne Limited (ABN 65 070 810 678) operating under the brand Linkt ("Linkt"). 

  3. The Program will be available until withdrawn by Linkt. Linkt will notify withdrawal or expiry of the Program by providing reasonable prior notice: 

    1. on its website; and 

    2. in its App(s) or through an email to its customers.

  1. To access the Program, you must: 

    1. be at least 18 years old;

    2. agree to these Terms and Conditions via the Program membership screen in the Linkt app or LinktGO app;

    3. be an active Linkt or LinktGO consumer customer with an active account (the Program is not available to commercial account customers or customers whose accounts are suspended); and

    4. consent to receive marketing and promotional offers from time to time from Linkt (however you can opt out at any time). 

  2. You only need to accept these Terms and Conditions once. Once these Terms and Conditions are accepted, you can view available Offers through the Program.

How to access Offers through the Program 

  1. Offers available to Members through the Program are accessed via the rewards tab in the Linkt app or LinktGO app. To redeem Offers through the Program you must: 

    1. click on the rewards tab in the Linkt app or LinktGO app (make sure you have the latest version of the app); 

    2. search and select an Offer; 

    3. accept the relevant Offer terms and conditions and privacy collection statement; and

    4. follow the redemption instructions outlined on the Offer tile. Redemption may involve presenting a voucher in store or being directed to a third party website to redeem an Offer, or another method which will be explained at the time of redemption.

Use of your information

  1. Your personal information will be collected by CityLink Melbourne Limited (ABN 65 070 810 678). We receive, collect, hold and disclose personal information about you in order to provide you with Program updates and information about Offers and for the purposes set out in our Privacy Policy

  2. We also use your personal information for the purpose of direct marketing and personalising messages to you (receiving exclusive Offers, updates about the Program and promotions, e.g. entry to competitions from Linkt, Offers we think might be of interest to you). You can opt out of receiving direct marketing from us at any time by clicking on the unsubscribe link in a communication or contacting us or updating your account preferences through the Linkt website. 

  3. We will collect, hold, use and disclose your personal information in accordance with our Privacy Policy at www.linkt.com.au/legal/policies/transurban-privacy-policy. Our Privacy Policy also explains:

    1. how we store and use, and how you may access and correct your personal information; 

    2. how you can lodge a complaint regarding the handling of your personal information; and

    3. how we will handle any complaint.

  4. If you would like any further information about our privacy policies or practices, please contact us by email to privacy@transurban.com.

  5. Linkt reserves the right to vary, amend or replace these Terms and Conditions at any time. If Linkt varies, amends or replaces these Terms and Conditions, it will provide you with reasonable prior notice in accordance with clause 5.  

  6. Offers are not exchangeable or transferable or redeemable for cash.

  7. If for any reason any aspect of the Program is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of Linkt, may, in its sole discretion, cancel, terminate, modify, or suspend the Program. 

  8. You are solely responsible for ensuring that you can read and access the Program on the Linkt App or LinktGO App at the time you wish to access the Program, including ensuring you have the latest version of the Linkt app or LinktGO app.

  9. Linkt reserve the right to disqualify you from the Program in the event of non-compliance with these Terms and Conditions. If there is a dispute concerning the conduct of the Program, the decision of Linkt is final and binding on you and no correspondence will be entered into. 

  10. Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these Terms and Conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law, including the Competition and Consumer Act 2010 (Cth).

  11. To the extent permitted by law, Linkt and its associated companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained except to the extent Linkt has caused or contributed to the loss, cost, expense, damage or injury by reason of its wilful misconduct, negligence or fraud.

  12. You agree and acknowledge that you may cease participation in the Program at any time.

  13. The Program and any Offer is to be used by Members only and not to be distributed or shared by any means. Where an eligible Member distributes or shares a redemption link in contravention of this provision, the Member will be liable for all loss or damage caused or contributed to by this breach. 

  14. The governing law and jurisdiction of these Terms and Conditions is Victoria, Australia.

Responsibility for Offers

  1. The Third Party named in the Offer, and not Linkt, is the seller, supplier and/or provider of the Offer. Under no circumstances is Linkt acting as the agent of the Third Party or as a supplier, reseller or distributor of any Offer.

  2. You must enter into separate terms and conditions with the relevant Third Party in order to redeem the Offer. You should make sure you review the applicable terms and conditions that apply to the Offer before redeeming the Offer to ensure that they are acceptable to you.

  3. If you redeem your Offer, but the Third Party does not provide the Offer, or if you have a complaint regarding the provision of the Offer, you should take action against the Third Party directly. Linkt does not promise or guarantee that the Offers are the best prices, terms or lowest rates available in the market. 

  4. In accessing the Program, you agree that Linkt is in no way responsible or liable to you for any products or services you purchase from a Third Party promoted through the Program or in connection with an Offer.
